What are you wearing?Due to non-compliance from the National Security Agency (NSA), the Justice Department’s Office of Professional Responsibility (OPR) has announced that the investigation into the warrantless domestic spying program has been dropped.

OPR head H. Marshall Jarrett wrote in a fax to Maurice Hinchey (Dem. NY), “We have been unable to make any meaningful progress in our investigation because OPR has been denied security clearances for access to information about the NSA program”. Since January, Jarrett’s office has made a number of requests to the NSA for the proper clearances. All of those requests were denied on Tuesday. “Without these clearances, we cannot investigate this matter and therefore have closed our investigation,” wrote Jarrett. Maurice Hinchey hasn’t found out why the NSA denied the Justice Department lawyers security clearance, but I’m sure this move to dodge accountability will be presented as an anti-terrorist necessity. All the better if their official excuse includes the GOP talking points of terrorist networks, 9/11, and the legality of unconstitutional conduct.
